You expressly agree that the use of this software is at your own risk. The software is provided on an "As Is" basis, without warranty of any kind, including without limitation the warranties that it is free of defects and errors, fit for a particular purpose, or non-infringing. JMS Solutions reserves the right to periodically update and/or upgrade the software at the company's discretion. Your installation of the software indicates your acceptance of potential future updates and/or upgrades to the software.
The information and services provided by the software and/or JMS Solutions are similarly provided on an "As Is" basis, without warranty of any kind. The accuracy and reliability of any information content or services provided by the software and or JMS Solutions should be independently verified by you as the user prior to making purchase decisions and or any other decisions based on such information content and services.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, in no event will JMS Solutions or its agents be liable for any damages arising from the use of or inability to use the software, including, without limitation, damages to users' systems and/or software and/or data, computer failure or malfunction, computer virus transmission, performance delays or communication failures, security breaches, Internet connectivity charges, bandwidth fees, or any and all other damages or losses.
FUNCTIONALITY
JMS Solutions provides users with advertising-supported versions of popular software applications free-of-charge or at a reduced cost. Downloading or installing these ad-supported software applications requires acceptance of this License Agreement which allows JMS Solutions to download and install software, which delivers web content, advertising, software, and various informational messages to computer screens for a period of one year.
By downloading this software, you give permission to JMS Solutions to display web content, advertising, contextual information and offers and to alter web content and search results. The software selects which content, ads and offers to display to individual users based on several factors, including: URLs associated with web pages visited by the user, search terms typed by the user into search engines, HTML content of the web pages viewed by the user, the user's timezone, the user's primary language, and the user's country.
AGE LIMITATION
JMS Solutions products and services are not available to individuals below the age of 18. By accepting this installation, you are representing that you are not a minor below the age of 18.
PRIVACY STATEMENT
Personal information such as names, postal addresses, email address, and phone numbers are ever transmitted to JMS Solutions or its agents. Certain demographic information maybe transmitted to JMS Solutions or its agents for use in determining the content to display on the user's computer. This information may include, but is not limited to, the user's country, timezone and language, ip address, a unique identifier generated by the software, the version of the software installed, recently visited URL's, and search terms typed into search engines.
GOVERNING LAW
This License is governed by the laws of the State of Ohio, without reference to conflict of laws principles. This Agreement is the entire agreement between you and JMS Solutions and supersedes any other communications or advertising with respect to the Software and documentation. If any provision of this License is held invalid, the remainder of this License shall continue in full force and effect.
